(Documents based on which forced execution can be initiated)<\/u><\/strong><\/h3><p class=\"wp-block-paragraph\"><\/p><p class=\"wp-block-paragraph\">According to the <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/304485\">Civil Procedure Code<\/a> the following are enforceable titles:<\/p><ul class=\"wp-block-list\"><li>Judgments with provisional execution;<\/li>\n\n<li>Final judgments;<\/li>\n\n<li>Notarized authentic instruments;<\/li>\n\n<li>Credit titles (negotiable instruments);<\/li>\n\n<li>Any other documents for which the law provides enforceable status.<\/li><\/ul><p class=\"wp-block-paragraph\"><\/p><h3 class=\"wp-block-heading\"><strong><u>Who are the Participants in the Execution Procedure?<\/u><\/strong><\/h3><p class=\"wp-block-paragraph\"><\/p><p class=\"wp-block-paragraph\">The essential parties for any execution file are: <strong><em>THE CREDITOR<\/em><\/strong> (the one who has the right to recovery\/fulfillment of the obligation), <strong><em>THE DEBTOR<\/em><\/strong> (the person obligated by the enforceable title), <strong><em>THEIR HEIRS<\/em><\/strong> (as applicable) and <strong><em>THIRD-PARTY GUARANTORS<\/em><\/strong> (persons third to the main obligation who guaranteed the debtor's debt and who are liable with their own assets in place of the debtor).<\/p><p class=\"wp-block-paragraph\"><\/p><h3 class=\"wp-block-heading\"><strong><u>Now that we\u2019ve cleared that up, let's see how you can actually get out of it!<\/u><\/strong><\/h3><p class=\"wp-block-paragraph\"><\/p><p class=\"wp-block-paragraph\">Your most common and effective weapon in this situation is the <strong>Your most common and effective weapon in this situation is the Challenge to enforced execution.
