Actualizarea codurilor CAEN conform noii reglementări se impune (în mod obligatoriu) pentru toate formele juridice din România, fiind necesar a fi revizuit atât codul principal de activitate, cât și codurile secundare regăsite în cuprinsul actului constitutiv. Respectiva actualizare a codurilor CAEN intervine ca și rezultat direct al Ordinului nr. 377 din 17 aprilie 2024 privind actualizarea Clasificării activităților din economia națională – CAEN.
How do I update the CAEN codes of my company / P.F.A. according to the new regulations?
The CAEN codes can be updated according to the new regulation before the Trade Register Office, by submitting the corresponding file (and filling in the specific forms), and the corresponding activity objects must be expressly mentioned in the new nomenclature.
What are the sanctions if I do not update my subject/objects of activity according to the new nomenclature?
Although currently there is not yet a series of well-defined sanctions that could be applied in case of failure to update the CAEN codes, we would like to inform you that any activity of the company/P.F.A.- etc. not complying with the new conditions would be tantamount to carrying out the activity in a state of illegality.
Subsequent problems that may arise from your refusal or failure to update your object of activity could relate to various sanctions/fines (when they will be regulated), problems in collaborations and partnerships (as nobody wants to be associated with an entity that is not 100% legal), contractual problems or difficulties in accessing funds or financing for the company.
What happens to applications/files submitted to the Trade Register before January 1, 2025?
Applications submitted by 31.12.2024 at the latest (according to the old CAEN REV. 2 regulations) will be dealt with by the Trade Register Office according to the legal rule in force at that time - i.e., by reference to the old regulation. However, it is the obligation/responsibility of each individual to take the necessary steps to update the CAEN codes at a later date, so that the company can operate in full legality and compliance.
